Terms and conditions

I. DEFINITIONS

The terms listed below in these Terms and Conditions shall have the meanings assigned to them in each case:

  1. Estudiantes: It is CLUB ESTUDIANTES DE LA PLATA ASOCIACIÓN CIVIL, CUIT: 30-52841228-5.
  2. Product/s: All and each of the Official Estudiantes Products sold at Tienda Pincha.
  3. Terms and Conditions: The general terms and conditions described herein.
  4. Tienda Pincha: The Official Web Store of Estudiantes, accessible through the website http://tiendapincha.com/.
  5. User/s: Any person who accesses the Website, whether registered or not.
  6. Website: The Tienda Pincha website: http://tiendapincha.com/.

II. GENERAL CONDITIONS

  1. The Terms and Conditions described below apply to browsing the WEBSITE and the services offered therein.
  2. The Terms and Conditions are mandatory and binding for all Users who access and/or use the Website and/or its services. Browsing the Website and using the Tienda Pincha services imply full knowledge and total and unrestricted acceptance of these Terms and Conditions, as well as the Exchange Policy and the Privacy Policy, published on the Website.
  3. The Website is designed for use by individuals aged eighteen (18) and older. Underage users must obtain the assistance of their parents or guardians to use the services offered on Tienda Pincha. Parents or guardians of underage or legally incapable users who use the Website shall be responsible for such use, including any charges, billing, or damage that may result from it.

III. PURCHASE OF PRODUCTS AT TIENDA PINCHA

  1. Estudiantes sells its Products on the Website exclusively to end consumers, on a retail basis. Therefore, Products purchased through this medium must be intended for personal use, either by the purchaser or third parties. Accordingly, Estudiantes reserves the right to reject any order that, at its reasonable discretion, does not meet this condition (for example, when the volume or characteristics of the order suggest a wholesale or professional purchase).
  2. The User who wishes to make a purchase at Tienda Pincha must verify the availability of stock for the Product before selecting it. The purchase of Products is subject to stock availability and will only be confirmed with the Order number sent to the User in the final stage of the purchase process and once payment has been completed.
  3. In the hypothetical and unlikely event that the selected Product(s) are out of stock or delayed and the purchase has still been confirmed, Estudiantes will contact the User and invite them to choose one of the following options: 1) Continue waiting for the delivery of the chosen product (in case of delay); 2) Cancel the purchase and receive a refund through the original payment method; 3) Choose an alternative product offered by Estudiantes for the particular case; 4) Cancel the purchase and receive a store credit for the same amount. If the user chooses to cancel the purchase, the amount paid will be refunded according to the originally selected payment method. If the user opts for the alternative product offered by Estudiantes, it must have equal or superior characteristics. Under no circumstances will the User be asked to pay additional sums or cover differences, except when the alternative product selected by the user is of significantly higher value and cost than the originally requested Product. For the situations contemplated in this section, the User will have a period of ten (10) days from the communication made by Estudiantes to choose one of the mentioned options. If the User remains silent, Estudiantes may presume that they have opted for the cancellation of the purchase and will proceed with the refund of the amount paid through the original payment method. Once the User has selected the Products they wish to purchase, they will be added to the shopping cart. At the end of the Product selection process, the User must click on the "View Cart" button to access the shopping cart summary page, where they can identify and correct any possible errors related to their purchase. At the end of the order summary page in the shopping cart, the User must click on the "Start Purchase" button to proceed with completing contact, delivery, recipient, and billing information. Once this is done, they must click on the "Continue to Payment" button, where they will choose the Payment Method and confirm the purchase if they opt for an online payment method or confirm the order if they choose an offline payment option, in which case the purchase will be subject to receipt of payment confirmation by Tienda Pincha.

IV. PRODUCT SHIPPING

  1. Estudiantes will deliver the Products purchased by the User at Tienda Pincha to the address provided by the buyer for this purpose during the purchase process.
  2. The User will be informed of the delivery costs before completing the purchase, and Tienda Pincha may waive the shipping cost according to commercial criteria, which will be communicated on the Website.
  3. Estudiantes will carry out national shipments with a delivery period of up to ten (10) business days, and international shipments, for which the delivery time will depend on the destination and the logistics operator.
  4. For remote areas with low population density and/or limited accessibility, special delivery times may apply, which will be communicated to the buyer during the purchase process.
  5. During discount periods and/or special promotions (Hot Sale, CyberMonday, and/or similar events), order processing and delivery times may be extended.
  6. The User can track their purchase through the tracking link received in the email provided during the Website purchase process. They can also obtain information through the contact form or by messaging Tienda Pincha on WhatsApp (+54 9 221 521-7103).
  7. Estudiantes will attempt delivery twice (2) at the address provided by the buyer during the purchase process, on different days. If the second delivery attempt is unsuccessful and the package is returned to Tienda Pincha, it will remain in the possession of Estudiantes, and the Buyer must contact Tienda Pincha to arrange for product pickup in the city of La Plata within the following five (5) business days. If delivery is ultimately impossible, and once the indicated holding period has expired, the purchase will be canceled, and a full refund will be issued. To pick up the purchased Product, the buyer must personally present proof of identity, or the pickup may be carried out by an authorized third party with a notarized power of attorney signed by the recipient, along with a copy of the recipient’s ID and the valid ID of the authorized party.

 

V. CURRENCY AND PAYMENT METHODS

  1. All prices on the Website are expressed in Pesos, the legal currency of the Argentine Republic.
  2. Payments may be made using credit and debit cards accepted by Pago Nube and/or Mercado Pago, bank transfers to CBU, cash, and Mercado Pago's "Installments without a Card" option. Additionally, for international purchases, payments may be made via PayPal.
  3. Payment processing will be carried out through the payment processing operator chosen by the Buyer. Tienda Pincha is not responsible for potential service interruptions by the payment processing companies nor for how they handle the information they process.

VI. RIGHT OF WITHDRAWAL OR PURCHASE REVOCATION. PRODUCT RETURNS

  1. According to Articles 1110 to 1116 of the Civil and Commercial Code of the Nation, the consumer has the inalienable right to revoke the acceptance of the purchase within ten (10) days from the conclusion of the contract or the delivery of the Product, whichever occurs later. If the deadline falls on a non-business day, it is extended to the next business day.
  2. The consumer must formally communicate this revocation to Tienda Pincha, which can be done using the "Right of Withdrawal" button available on the Website, and must return the Product, which must be in perfect condition. The return costs are covered by Estudiantes. If the consumer exercises the right to revoke the purchase in a timely and proper manner, both parties are released from their respective obligations and must reciprocally and simultaneously return what they have exchanged.
  3. To exercise the Right of Withdrawal, the Products must not have been used by the User and must be in the same condition in which they were received, including their packaging and labels. For example, if the product is in its plastic wrapping ("blister"), it must be opened neatly and carefully; otherwise, the purchase revocation will not be accepted.
  4. This legal right of revocation does not apply to the purchase of products made to the consumer's specifications or clearly personalized, or that by their nature cannot be returned or may deteriorate quickly (including but not limited to underwear, socks, swimsuits, and any clothing or product that has been customized, embroidered, or otherwise modified at the consumer's request).
  5. The legal right of revocation must be exercised in good faith. The law does not protect the abusive exercise of rights. An abusive exercise is one that contradicts the purposes of the legal system or exceeds the limits imposed by good faith, morality, and good customs.
  6. The refund of amounts paid by the User will be made once the Product is received and provided it meets the conditions stipulated in these Terms and Conditions. Once the Product is received, the refund may take up to ninety-six (96) business hours due to administrative and processing times. For refunds via bank transfer, the bank account must be in the name of the User who made the transaction.

VII. LEGAL NOTICES

  1. These Terms and Conditions may be freely modified by Estudiantes by updating this publication.
  2. If the information or data provided by the User is not truthful, the User will be responsible for any damages that may arise from this situation.
  3. Estudiantes reserves the right to interrupt, suspend, or modify at any time the services offered on this Website, whether permanently or temporarily. User consent or prior notice is not required. Likewise, continuous or permanent access to the Website is not guaranteed, as it may be interrupted due to technical issues beyond Estudiantes' control. However, if the mentioned suspension or interruption is not due to force majeure or unforeseen circumstances, Estudiantes commits to fulfilling any outstanding obligations at the time of suspension or interruption.
  4. These Terms and Conditions are governed and interpreted in accordance with Argentine laws, without reference to its conflict of law provisions. If any part of these Terms and Conditions becomes illegal, invalid, or unenforceable, that part will be severed and will not affect the validity and enforceability of the remaining provisions.
  5. Any dispute, disagreement, or conflict arising from the interpretation, validity, scope, and/or application of these Terms and Conditions, as well as any dispute arising from the purchase of Products on Tienda Pincha, will be submitted to the jurisdiction of the Ordinary Civil and Commercial Justice of the Judicial Department of La Plata, Province of Buenos Aires, waiving any other jurisdiction that may apply.
